
Dobinson Davey Clifford Simposn was the first law firm in Australia to use Collaborative
Law in a family law matter.
Collaborative Law is a client centred approach to resolving family law issues. It
involves both parties and both parties' lawyers commiting to negotiate an agreement
without going to court. A multi-disciplinary team including communication coaches,
child specialists, an independent financial expert and the lawyers work with clients
at a pace agreed to by the clients to assist them generate and evaluate options,
communicate respectfully, and move towards a mutually agreeable outcome. The parties,
their lawyers and other members of the multi disciplinary team enter into a written
agreement at the commencement of the process in which the lawyers agree that they
will not represent the parties in Court proceedings in the event that the collaborative
process is not successful.
